General Notes and Anecdotes
While Daniel is noted by The History and Map of Danby, Vermont as a respected citizen in hs early days, it also notes a darker side. He is identified as an alcoholic, and "quarrelsome" when intoxicated. The history then relates an incident in 1820 with Ephraim Briggs (another "quarrelsome" alcoholic) at the Red Tavern. At some point a dispute erupted. The fight resulted in the death of Briggs after Daniel jumped "with both feet into his breast." Daniel was arrested and charged with murder, but was acquitted by Barton Bromly, Esq. (who was not explicitly identified as a judge). The source doesn't note that this was a proper trial, the implication being that is was just a hearing. Brigg's friends were not satisfied and managed to have Daniel arrested a second time. In this case, he was convicted in a jury trial and sentenced to prison for life. According to the source, he received his sentence calmly and "politely thanked the judge 'that his sentence was not for a longer term.'" However, Daniel only served a couple of years. He was released after a petition requesting a commutation was presented to the governor and granted. After his release, Daniel remained in Danby for many years before moving to Wallingford.
